Judge Jim Reynolds courageously blocked parts of SB 423 that he believed were unconstitutional on June 30, 2011. He stated that commercial industries that deal with medical marijuana like barbers, lawyers, doctors, accountants, and distributors deserve the same rights as any other professional to collect a profit.
In addition to this ban the Judge banned the new law from limiting a distributor to having a maximum of three patients, allowing police to hold unannounced searches of these distributors, having a forced investigation of doctors who provide more than 25 medical marijuana recommendations, and a ban on medical marijuana advertising.
Thank goodness for Judge Reynolds, it is always liberating to see people rule justly in favor of medical marijuana and against federal propaganda that has kept it a schedule one drug for too long. Assistant Attorney General Jim Molloy who favored the new law said that the state would not object to the bans that Judge Reynolds enacted.
Although this is a big step in medical marijuana law clarification in Montana, we cannot neglect the fact Federal agents have been raiding dispensaries in the state and has caused a huge amount of terror for the 30,000 medical marijuana patients and care givers in the state.
Baby steps still move us forward,
