Rochester has 25 dispensaries licensed by the New York Office of Cannabis Management (OCM). Any adult 21 or older with a valid government photo ID can shop, and visitors can use an out-of-state license or a passport. Certified medical patients 18 and older can use Rise on Jefferson Road or Curaleaf on Chili Avenue. Rochester has more licensed stores than any other city in upstate New York.
Rochester said yes. The City of Rochester opted in to allow licensed dispensaries, microbusinesses and consumption lounges, and the City Council set zoning and "time, place and manner" rules for them. The city also reviews each license application and can object to one on specific grounds. One thing to know about the count: OCM files stores by mailing address, so this page includes stores with a Rochester address in the suburbs, such as the Jefferson Road strip in Henrietta and Empire Boulevard on the Webster side.

Rochester and New York Cannabis Laws: Purchase Limits, Public Use and Driving
Adults may carry up to 3 ounces of cannabis and 24 grams of concentrated cannabis, edibles and oils included, and stores use those amounts as a daily limit. At home, adults may keep up to 5 pounds, stored securely, and grow 3 mature and 3 immature plants each. Read our New York marijuana laws guide for penalties and details.
- Public use: The City of Rochester's guidance is that cannabis may be smoked wherever cigarettes may be smoked. Restaurants, bars, indoor workplaces and other smoke-free places are off limits, and landlords may ban smoking in their buildings.
- Cars and parking lots: No cannabis use in a vehicle, and the city notes this includes cars on a public street, in street parking and in most parking lots and garages.
- Events: The city says it is not authorizing cannabis showcase events at present.
- Canada: Rochester sits on Lake Ontario across from Canada. Taking cannabis across the border is illegal, even though Canada has legalized it.
Cannabis Taxes in Rochester
Rochester shoppers pay New York's 13% retail tax on adult-use cannabis: a 9% state excise and a 4% local excise. The local 4% is split between Monroe County and the city, town or village where the store sits, so it funds local government wherever you shop. There is no sales tax on adult-use cannabis, and a 9% distributor tax is built into the price. Compare states in our cannabis prices by state report.
Medical Marijuana in Rochester
Certified patients can buy at Rise on Jefferson Road or Curaleaf on Chili Avenue with their certification and a photo ID. A certification lasts up to two years, patients may name up to five caregivers, and medical purchases skip the 13% retail tax.
