No, not for recreational use. Iowa allows only a limited medical program that sells non-smokable cannabis products to registered patients, capped at 4.5 grams of total THC every 90 days, and possessing marijuana without a card is a serious misdemeanor. A first possession offense carries up to 6 months in jail and a $1,000 fine. That is the law as of October 2026.

This guide is for Iowa residents and for visitors from Minnesota and other states where cannabis is legal. It covers penalties, the medical program, hemp THC products and driving. It is general information, not legal advice.

Is Marijuana Legal in Iowa?

Not for recreational use. Iowa has never legalized adult-use cannabis or decriminalized possession. The state’s medical program, created by the Medical Cannabidiol Act in 2017 and run today by the Iowa Department of Health and Human Services as its Medical Cannabis Program, is one of the most restrictive in the country.

In April 2026 the Justice Department moved marijuana held under a state medical marijuana license to federal Schedule III. Adult-use and unlicensed marijuana remain in Schedule I. See our federal marijuana law guide.

Marijuana Possession Penalties in Iowa

Penalties come from Iowa Code 124.401(5), with fine ranges set by Iowa Code 903.1:

  • First offense: up to 6 months in county jail, a fine up to $1,000, or both.
  • Second marijuana offense: punished as a serious misdemeanor: a fine of $430 to $2,560 and up to 1 year in jail.
  • Third or later marijuana offense: an aggravated misdemeanor, with up to 2 years in prison and a fine of $855 to $8,540.

Courts may suspend sentences and order probation with drug treatment or education. Possession with intent to deliver, or manufacturing, 50 kilograms or less of marijuana is a class D felony under Iowa Code 124.401(1)(d), and the felony classes climb with weight above that.

Iowa’s Medical Cannabis Program

Who qualifies

Under Iowa Code 124E.2, qualifying conditions include cancer with severe pain, nausea or wasting; multiple sclerosis with severe muscle spasms; seizures; AIDS or HIV; Crohn’s disease; ALS; terminal illness with a life expectancy under one year; Parkinson’s disease; chronic pain; severe, intractable autism with self-injurious or aggressive behaviors; and post-traumatic stress disorder.

Getting a card

Patients must be 18 or older, give an Iowa residence address on their application and be certified by their health care practitioner. House File 990 (signed June 2, 2026, in effect July 1, 2026) dropped the older “permanent resident” wording and lets the state license up to ten medical cannabidiol dispensaries, up from five. The card costs $100, or $25 for patients who receive Social Security disability benefits or SSI or who are enrolled in Medicaid, and it expires after one year under Iowa Code 124E.4. Caregivers pay $25.

How much patients can buy

A dispensary may not sell more than 4.5 grams of total THC to a patient and caregiver combined in a 90-day period under Iowa Code 124E.9. A practitioner can certify a higher cap for a terminally ill patient or for a patient whose condition is not adequately treated by 4.5 grams. Iowa counts THCA toward total THC at 87.7%.

Rules for patients

  • Smoking medical cannabis is prohibited under Iowa Code 124E.17, and manufacturers may not make edible products.
  • Patients may not consume products at a dispensary.
  • Out-of-state medical cards are recognized for possession, but visiting patients may not buy from Iowa dispensaries under Iowa Code 124E.18.
  • Employers and landlords may still ban marijuana use on their property under Iowa Code 124E.21 and 124E.23.

Growing Marijuana in Iowa

Home growing is illegal for everyone, including medical patients. Cultivation is manufacturing a controlled substance under Iowa Code 124.401(1), and amounts of 50 kilograms or less are a class D felony.

Driving and Cannabis in Iowa

Iowa has a zero-tolerance drugged driving rule. Under Iowa Code 321J.2, a person commits operating while intoxicated by driving while any amount of a controlled substance is present in the blood or urine, even without signs of impairment. A first offense is a serious misdemeanor with a minimum of 48 hours in jail; a second is an aggravated misdemeanor; a third is a class D felony. The statute provides an affirmative defense only for drugs taken as prescribed or dispensed under a practitioner’s directions.

Hemp, CBD and Delta-8 in Iowa

Iowa regulates hemp-derived THC products under Iowa Code chapter 204, overhauled in 2024:

  • A consumable hemp product may contain no more than the lesser of 0.3% total THC or 4 mg per serving and 10 mg per container.
  • Selling to anyone under 21 is a simple misdemeanor, and people under 21 may not possess, buy or use these products.
  • Possessing or selling hemp for inhalation, including smokable flower and vapes, is a serious misdemeanor under Iowa Code 204.14A.
  • Registered sellers may not sell synthetic consumable hemp products as defined by HHS rules.
  • Manufacturers and retailers must register with Iowa HHS, which may confiscate noncompliant products.

Federal law tightens further: a November 2025 law caps hemp products at 0.4 milligrams of total THC per container and excludes converted cannabinoids, effective November 12, 2026 for cannabinoids the plant cannot naturally produce, such as THC-O, and December 11, 2026 for everything else, including delta-8.

Bringing Cannabis Into Iowa From a Legal State

Cannabis bought legally in a neighboring state is illegal in Iowa. Possession is charged under Iowa Code 124.401(5) no matter where it was purchased, and driving with THC in your system can be charged as OWI. Carrying cannabis across state lines is also illegal under federal law. See our Minnesota marijuana laws guide for the rules on that side of the border.
