Delaware has 14 licensed cannabis dispensaries in 12 towns, all licensed by the Delaware Office of the Marijuana Commissioner (OMC). Every one of them sells to adults 21 and older with a valid government-issued photo ID and also serves registered medical patients. A store may sell one customer up to 1 ounce of leaf marijuana, 12 grams of concentrate or products with 750 milligrams of THC in a single transaction, and adult-use purchases carry a 15% marijuana tax.
Adult-use sales in Delaware began on August 1, 2025, so this is one of the youngest legal markets in the country and one of the smallest. Below you will find every store in the state with its address and county, a look at each county, and the rules that matter at the counter. Each listing opens to a map and contact details. Every Licensed Dispensary in Delaware
With only 14 stores, the whole state fits in one table. Wilmington is the only town with more than one store, at 3. The other 11 towns have one each. The stores trade under 6 names: AYR Wellness (3), Fresh Delaware (3), The Farm (3), Best Buds (2), Thrive Dispensary (2) and Field Supply Cannabis & Provisions (1). Several of these names run a store in more than one county, so the same name can turn up both in Wilmington and near the beaches.

Delaware Dispensaries by County
Delaware has three counties, and each has licensed stores: New Castle in the north, Kent in the middle and Sussex in the south. Stores are spread almost evenly, 5 in New Castle County, 4 in Kent and 5 in Sussex. Four of them have Dupont Highway or Dupont Boulevard addresses, the old north-south road that ties the state together, so a drive down the middle of Delaware passes most of the market.
New Castle County (5 stores)
Wilmington has 3 stores, all with Wilmington mailing addresses but none downtown. They sit on Concord Pike, Kirkwood Highway and Germay Drive, out among the suburban shopping roads. Newark, home of the University of Delaware, has one store on Ogletown Road, and New Castle has one on South Dupont Highway. This is the county closest to Pennsylvania and to the Delaware Memorial Bridge into New Jersey, but taking cannabis across either line is illegal. If you live over the line, see our Pennsylvania dispensaries and New Jersey dispensaries.
Kent County (4 stores)
Dover, the state capital, has one store on Jefferic Boulevard. Smyrna, at the north end of the county, has one on South Dupont Highway. Felton, south of Dover, has one on Irish Hills Road. Milford has one on North Dupont Boulevard. Milford straddles the Kent and Sussex line, and this store sits on the Kent side. Kent is the shortest drive for most of central Delaware and for travelers on Route 1 between the bridge and the beaches.
Sussex County (5 stores)
Sussex is the largest county by land and the one most visitors see in summer. Rehoboth Beach and Lewes each have one store near the coast, and Lewes is where the Cape May-Lewes Ferry leaves for New Jersey. Do not carry cannabis onto the ferry; it crosses state waters and ends in another state. Georgetown, the county seat, has one store. Seaford, in the western part of the county, has one on Sussex Highway, and Frankford, inland from Fenwick Island, has one on Dupont Boulevard. Maryland is a short drive from both; see our Maryland dispensary directory if you are staying on that side.
Who Runs Delaware's Stores
Delaware's adult-use market opened with a select group of existing medical compassion centers that converted their licenses to sell to adults as well, according to the state's launch announcement. The Delaware Marijuana Control Act, now Chapter 13 of Title 4 of the Delaware Code, set up these conversion licenses. Under 4 Del. C. §§ 1335A and 1335B, a converted store must keep running as a medical dispensing location, put patients first if supplies run short, keep a range of medical products and file its maximum prices with the Commissioner.
That history explains why all 14 stores in our directory serve both adult customers and patients, and why each listing carries both the adult-use and medical labels. The law also provides for new retail licenses beyond the converted centers. We add new stores when they appear on the OMC's list of authorized locations.
Local rules: A city or town may ban marijuana businesses by ordinance or by an initiated or referred measure under 4 Del. C. § 1351. Counties have less room. Under § 1351A, a county may not ban a retail store from commercial or industrial zones, but it can keep stores half a mile apart and 500 feet from schools, colleges and licensed child care. That spacing is one reason stores sit along highways rather than in town centers.
Buying Cannabis in Delaware: ID, Limits and Hours
- Age and ID: Before a sale, staff must check a valid government-issued photo ID showing you are 21 or older, under 4 Del. C. § 1332. Out-of-state adults can buy. Anyone under 21 who knowingly enters a licensed store faces a $50 civil penalty.
- Per-transaction limit: A store may not sell more than a personal use quantity in one transaction. Under 16 Del. C. § 4701, that means 1 ounce or less of leaf marijuana, 12 grams or less of concentrated cannabis, or products with 750 milligrams or less of delta-9 THC. Topicals such as lotions and balms do not count toward the cap.
- Possession: Adults may carry the same personal use quantity. Having more is an unclassified misdemeanor with a fine of up to $575, up to 3 months in jail, or both.
- Store hours: Under 4 Del. C. § 1309, stores may not sell between 10 p.m. and 9 a.m. Monday through Saturday, or before noon or after 8 p.m. on Sunday. From October through December, stores may open at 8 a.m. on Fridays and Saturdays and at 10 a.m. on Sundays. Selling on Sunday takes a separate license, so not every store opens that day.
- Holidays: No sales on Thanksgiving, Easter or Christmas.
- In store only: A store may not sell over the internet or deliver to anyone who is not physically in the store, and you may not use cannabis on the premises.
- THC drinks: Since October 21, 2026, retail marijuana stores and package stores may sell infused drinks with no more than 10 milligrams of delta-9 THC per single-serving container, under § 1309A.

Medical Marijuana at Delaware Dispensaries
Delaware's medical program, the Delaware Medical Marijuana Program, runs under the Delaware Medical Marijuana Act in 16 Del. C. Chapter 49A and is administered by the Office of the Marijuana Commissioner. A registered patient may possess up to 6 ounces of usable marijuana. Every store in our directory serves registered patients, and 14 listings carry the medical label.
When a compassion center converts, it must commit to selling patients marijuana tax-free, up to 3 ounces in any 14-day period and up to 6 ounces a month, and to offering home delivery to patients. The OMC FAQ also says patients from other states can buy at Delaware medical dispensaries by filling out a visiting patient application at the store, with a photo of their driver's license and their home-state card. This page is general information, not medical advice.
Delaware Cannabis Taxes and Prices
- 15% marijuana tax: Charged on the retail sales price under 4 Del. C. § 1382 and shown as its own line on your receipt.
- No local add-ons: Under § 1383, the state tax replaces county and town license fees and taxes on the business of selling marijuana. Delaware has no general sales tax, so 15% is the whole tax at the register.
- Medical sales: Purchases by registered patients are exempt.
- THC drinks: Infused drinks sold by a marijuana store or package store are exempt from the 15% tax.
- No bundle deals: A store may not discount marijuana or give it away free when you buy something else.
With so few sellers, menus can differ a lot from one store to the next. Compare a few before you drive, and see our cannabis prices by state for context. If you are new to the products on the shelf, our Cannabis 101 guide and strain guides explain the basics.
Where You Can Use What You Buy
- Not in public: Using marijuana in an area accessible to the public is an unclassified misdemeanor with a fine of up to $200, up to 5 days in jail, or both, under 16 Del. C. § 4764. The law counts sidewalks, streets, parking lots, parks, stores and restaurants, and any outdoor spot within 10 feet of them or of a building's doors, open windows or air intakes. That covers boardwalks and beaches.
- Private property: Use at a private home is legal with the owner's permission. Owners, employers and hotels may ban it under § 1307. A landlord may always ban smoking, but may ban possession or non-smoked use only in limited cases, such as an owner-occupied house with no more than 3 rented rooms.
- In the car: Using marijuana in a moving vehicle is a misdemeanor, and the OMC says consuming in any vehicle is illegal. Carry purchases in a closed container or out of reach. Driving under the influence of any drug is a crime under 21 Del. C. § 4177.
- No home grow: Growing marijuana without a license remains illegal for adults under § 4764A, and the OMC says patients and caregivers may not grow either.
- State lines: The OMC warns that it is illegal to leave or enter Delaware with any marijuana products. Federal law also applies on federal land. Our federal marijuana law guide has more, and our state-by-state cannabis law guides compare the rules next door.
Before You Visit a Delaware Dispensary
- Plan around the clock: Stores close by 10 p.m. on weekdays and Saturdays and by 8 p.m. on Sunday, and some do not open Sunday at all.
- Heading to the beach? The coastal stores are in Lewes and Rehoboth Beach. Georgetown, Frankford and Seaford are the inland options in Sussex County.
- Count before checkout: A store cannot ring up more than one personal use quantity in a single transaction, so plan a bigger order around the cap.
- Finish it here: Whatever you buy has to stay in Delaware. Use it at a private home where you have permission.

How we build this directory: Store names and addresses come from the Delaware Office of the Marijuana Commissioner's list of authorized retail locations. Our copy of that list does not include license numbers, so our Delaware listings do not show them. We check each store against map data and refresh the list as new stores open, so our count can differ slightly from the state's. We assign each store to a county by its address. For the rules in every state, see our state-by-state cannabis law guides.
