No. Recreational marijuana is illegal in West Virginia, but registered medical cannabis patients with one of 15 qualifying conditions can legally buy it from state-permitted dispensaries. For everyone else, possessing any amount is a misdemeanor punishable by 90 days to six months in jail, a fine of up to $1,000, or both, though a first offense under 15 grams must go through conditional discharge. That is the law as of October 2026.

This guide is for residents weighing a medical card and for visitors from neighboring states where cannabis is legal. It links each rule to the West Virginia Code and is general information, not legal advice.

Is Marijuana Legal in West Virginia?

Only for registered medical patients. Senate Bill 386, the Medical Cannabis Act, was signed in 2017, and a 2019 law (SB 1037) raised the dispensary permit cap to 100. Dispensaries opened in 2021. The Office of Medical Cannabis (OMC) runs the program.

Outside the program, the Medical Cannabis Act states plainly that “the use of medical cannabis is unlawful” except as the Act allows, under W. Va. Code 16A-3-3. There is no adult-use or decriminalization law, and West Virginia has no citizen ballot initiative process.

Penalties for Marijuana Possession in West Virginia

Possessing a controlled substance without a valid prescription or authorization is a misdemeanor under W. Va. Code 60A-4-401(c), punishable by 90 days to six months in jail, a fine of up to $1,000, or both. The same section says a first offense involving less than 15 grams of marijuana “shall be disposed of” under the conditional discharge statute.

Under W. Va. Code 60A-4-407, a person with no prior drug conviction can be placed on probation. Completing it means dismissal without a conviction, and the person may seek expungement six months after probation ends. It is available once.

Growing, selling or possessing marijuana with intent to deliver is a felony. For a Schedule I substance that is not a narcotic, 60A-4-401(a) sets one to five years in prison, a fine of up to $15,000, or both.

West Virginia Medical Cannabis Program

Qualifying conditions

A registered physician must certify that the patient has one of the “serious medical conditions” listed in W. Va. Code 16A-2-1:

  • Cancer; HIV or AIDS; amyotrophic lateral sclerosis (ALS); Parkinson’s disease; multiple sclerosis
  • Spinal cord nerve damage with intractable spasticity; epilepsy; intractable seizures; neuropathies
  • Huntington’s disease; Crohn’s disease; post-traumatic stress disorder; sickle cell anemia
  • Severe chronic or intractable pain
  • Terminal illness

Getting a card

After the physician certification, patients apply online to the OMC and pay a $50 application fee, which can be waived for applicants at or below 200% of the federal poverty level. Cards expire one year after approval, and renewal requires a new physician certification. Patients under 18 need a registered caregiver, and adult patients may designate one.

The program is for West Virginia residents. West Virginia does not accept out-of-state medical cards, and a West Virginia card gives no protection in other states.

What patients can buy

The Act allows pills, oils, topicals, tinctures, liquids, dermal patches and forms “medically appropriate for vaporization or nebulization,” under W. Va. Code 16A-3-2. Dry flower is sold for vaporizing under OMC rules. Two things remain illegal for patients under 16A-3-3: smoking medical cannabis, and dispensaries selling edibles. Patients may mix cannabis into food themselves.

The OMC purchase limit is up to 6 ounces of flower or 60 grams of concentrate, or an equivalent combination, per rolling 30-day period, unless the physician sets a lower amount. Purchases are tracked against the patient’s card. Dispensaries pay a 10% tax on gross receipts, built into the price rather than added at the register.

Where You Can Use Medical Cannabis

Patients should use cannabis in a private residence. Smoking is banned outright, and there are no lounges or consumption sites. On federal land, such as New River Gorge National Park, a state card offers no protection.

Can You Grow Marijuana in West Virginia?

No. The Medical Cannabis Act makes it unlawful to grow cannabis without a grower permit from the state, under 16A-3-3. That applies to patients too. No patient home-grow bill has passed as of October 2026.

Driving and Marijuana in West Virginia

West Virginia has no THC blood limit. Under W. Va. Code 17C-5-2, a driver is impaired if “under the influence of any controlled substance,” and a first offense is a misdemeanor with up to six months in jail and a fine of $100 to $500, plus license revocation. A medical card is not a defense to impaired driving.

Delta-8, THCA and Hemp Products in West Virginia

Hemp-derived cannabinoid products, including delta-8, delta-10, HHC and THCV, are legal under state law when they meet the 0.3% delta-9 THC limit, are approved and labeled under Department of Agriculture rules, and are sold only to adults 21 and older, under W. Va. Code 19-12E-12. Selling to anyone under 21 is a felony carrying one to five years in prison. Retail sales carry an 11% privilege tax.

Congress redefined hemp in November 2025 to a total-THC standard with a cap of 0.4 mg total THC per container. Cannabinoids the plant cannot naturally produce, such as THC-O, lose federal hemp status on November 12, 2026, and the remaining limits, including the exclusion of delta-8 made from CBD, take effect December 11, 2026. See our federal law guide.

Crossing State Lines, Airports and Federal Law

Cannabis bought legally in Ohio, Maryland or Virginia becomes misdemeanor possession once it enters West Virginia, and crossing a state line with it is a federal offense. At Yeager Airport and other West Virginia airports, TSA follows federal law and refers cannabis found at screening to police.

In April 2026 the Justice Department moved marijuana held under a state medical marijuana license to Schedule III. Other marijuana remains in Schedule I, and the hearing on broader rescheduling was stayed on September 29, 2026.

What Changed in West Virginia Cannabis Law Recently

  • Program fund veto (2026): The Legislature passed HB 5074 to direct Medical Cannabis Program Fund money to research and substance use programs. Gov. Patrick Morrisey vetoed it in April 2026, objecting that it left nothing for general revenue.
  • Program bills (2026): HB 5260 passed the House on March 4, 2026, but stalled in a Senate committee.

From the editor, James Buddsey: West Virginia is a medical state, full stop. A legal purchase in Ohio or Maryland does not travel with you, and here a few grams can still mean a criminal case.
