No. Marijuana is illegal in Idaho for both recreational and medical use: the state has no dispensaries, no medical marijuana program and no decriminalization law, and possessing any amount is a crime. Up to 3 ounces is a misdemeanor with a mandatory minimum $300 fine for adults 18 and older, more than 3 ounces is a felony, and cannabis bought legally in Washington or Oregon becomes illegal the moment it crosses into Idaho. That is the law as of October 2026.
This guide is for Idaho residents and the many Idahoans who shop in Spokane or Oregon border towns. It covers penalties, bringing cannabis home, hemp and CBD, and the November 2026 ballot question on who can legalize marijuana, which voters rejected. It is general information, not legal advice.

Is Marijuana Legal in Idaho?
No. Idaho defines marijuana broadly as all parts of the cannabis plant, its seeds and resin, and any extract or preparation containing THC, under Idaho Code 37-2701. The Legislature has never created a medical program or reduced possession to a civil fine, and Idaho voters have never approved a cannabis measure.
The federal changes of 2026 do not change that. In April 2026 the Justice Department moved marijuana held under a state medical marijuana license, and FDA-approved marijuana products, to Schedule III. Idaho issues no such licenses, so nothing in Idaho qualifies, and adult-use marijuana remains in Schedule I under federal law. Our federal marijuana law guide has the details.
Marijuana Possession Penalties in Idaho
Idaho grades possession by weight under Idaho Code 37-2732(e):
- 3 ounces or less: a misdemeanor punishable by up to 1 year in jail, a fine up to $1,000, or both. Since a 2025 law (House Bill 7), anyone 18 or older convicted at this level must pay a fine of at least $300.
- More than 3 ounces: a felony punishable by up to 5 years in prison, a fine up to $10,000, or both.
- 1 pound or more, or 25 plants or more: trafficking under Idaho Code 37-2732B, with mandatory minimums that rise from 1 year and $5,000 (1 to 5 pounds, or 25 to 49 plants) to 3 years and $10,000 (5 to 25 pounds, or 50 to 99 plants) and 5 years and $15,000 (25 pounds or more, or 100 plants or more). The maximum is 15 years and $50,000.
Extracts and THC preparations count toward the weight. Pipes, bongs and similar items are paraphernalia, a separate misdemeanor under Idaho Code 37-2734A.
Bringing Cannabis Back From Washington or Oregon Into Idaho
This is the question we hear most from Idaho readers. The short answer: buying is legal in Spokane or Ontario for adults 21 and over, but the purchase stops being legal at the state line. Idaho law does not care where the cannabis was bought, whether it came from a licensed store, or whether you kept the receipt.
- Small amounts are still a crime. A pre-roll, a vape cartridge or a single gummy brought home is possession under Idaho Code 37-2732(e), with the $300 minimum fine for adults 18 and older.
- Weight adds up fast. Washington lets adults buy 1 ounce of flower plus edibles and concentrates in one trip, and Oregon allows 2 ounces of flower a day. Anything over 3 ounces total in Idaho is a felony, and 1 pound or more is trafficking. Idaho’s trafficking law specifically covers anyone who “brings into this state” a trafficking amount.
- Edibles and vapes count. Idaho’s marijuana definition covers extracts and THC preparations, so a Washington gummy or an Oregon cartridge is treated as marijuana in Idaho.
- Federal law applies too. Carrying cannabis across any state line is illegal under federal law, even between two legal states.
- Using it before you drive home is no safer. Idaho charges DUI based on impairment, and a lawful purchase is no defense (see driving below).
The only legal way for an Idaho resident to use cannabis is to buy and consume it inside Washington or Oregon, on private property where the owner allows it, and to come home sober with nothing in the car. Our guide for Idaho visitors to Spokane covers where to buy and where you can legally consume, and the Washington and Oregon marijuana laws guides explain each state’s purchase limits and public-use rules.
Medical Marijuana in Idaho
Idaho has no medical marijuana program and does not honor medical cards from other states. The marijuana definition in Idaho Code 37-2701 excludes only two narrow categories of medicine: FDA-approved drugs containing cannabidiol with no more than 0.1% residual THC, and nabiximols.
A medical cannabis initiative, the Idaho Medical Cannabis Act, tried to reach the November 2026 ballot. On July 14, 2026, the Secretary of State’s office announced it had not qualified, falling short of both the total valid signatures and the required number of legislative districts, the Idaho Capital Sun reported.
Growing Marijuana in Idaho
Growing any amount is illegal. Cultivation counts as manufacturing a Schedule I nonnarcotic controlled substance, a felony punishable by up to 5 years in prison and a $15,000 fine under Idaho Code 37-2732(a)(1)(B). Twenty-five plants or more, regardless of size, triggers the trafficking statute and its mandatory prison terms.
Hemp, CBD, Delta-8 and THCA in Idaho
Idaho defines hemp as cannabis with no more than 0.3% THC on a dry weight basis, counting both delta-9 THC and THCA, under Idaho Code 37-2701. Plant material or a derivative that contains THC and does not qualify as legal hemp is presumed to be marijuana. Because THCA counts toward the limit, high-THCA flower sold as hemp elsewhere is generally marijuana in Idaho.
Retail rules are stricter still. Stores offering hemp products meant to be eaten or inhaled fall under the state hemp law, Idaho Code 22-1705. At a March 24, 2026 Senate committee hearing on that change (House Bill 879), the Idaho State Department of Agriculture director said delta-8 and delta-9 THC are both covered by Idaho Code and confirmed that legal hemp products sold in Idaho contain no THC, according to the committee minutes. Treat delta-8 gummies, THC vapes and THCA flower as illegal in Idaho.
Federal law is tightening too: a November 2025 law caps hemp products at 0.4 milligrams of total THC per container and excludes converted cannabinoids, effective November 12, 2026 for cannabinoids the plant cannot naturally produce, such as THC-O, and December 11, 2026 for everything else, including delta-8.
Driving After Using Cannabis in Idaho
Idaho Code 18-8004 makes it a crime to drive while under the influence of drugs or any other intoxicating substance. There is no THC blood limit, so charges rest on observed impairment, and being lawfully entitled to a drug is not a defense.
What Changed in Idaho Cannabis Law Recently
- HJR 4 rejected on November 3, 2026: The Legislature passed House Joint Resolution 4 in March 2025 (58-10 in the House, 29-6 in the Senate), according to the Idaho Legislature’s bill page. The constitutional amendment would provide that only the Legislature has the power to legalize marijuana, narcotics or other psychoactive substances, which would have ended the use of citizen initiatives for that purpose. It appeared on the November 2026 ballot, Ballotpedia reported. Voters rejected it, 459,661 (66.2%) to 234,278 (33.8%), with all 44 counties reporting in the Secretary of State’s unofficial results as of the morning of November 4, 2026, so citizens keep the power to propose legalization by initiative. Marijuana remains illegal. See our 2026 marijuana election results.
- Minimum fine (2025): House Bill 7 added the $300 minimum fine for possession of 3 ounces or less by adults 18 and older.
- Hemp retail oversight (2026): Idaho Code 22-1705 now covers establishments selling hemp products intended for ingestion or inhalation.
From the editor, James Buddsey: Readers from Coeur d’Alene and Post Falls often assume a small amount from a Spokane store is fine because they bought it legally. It is not. Enjoy it in Washington or Oregon, and leave it there.
